We will make reasonable efforts to provide notice when practical, but are not obligated to maintain backward compatibility.

• NON-INFRINGEMENT;
• AVAILABILITY;
• ACCURACY;
• RELIABILITY.

WE DO NOT GUARANTEE THAT THE APIS WILL OPERATE WITHOUT INTERRUPTION OR ERROR.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BABASMS SHALL NOT BE LIABLE FOR:

• INDIRECT DAMAGES;
• INCIDENTAL DAMAGES;
• SPECIAL DAMAGES;
• CONSEQUENTIAL DAMAGES;
• LOST PROFITS;
• LOST DATA;
• BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR API SERVICES DURING THE THREE (3) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless Babasms, its officers, employees, affiliates, partners, and service providers from any claims, liabilities, damages, costs, or expenses arising from:

• Your API usage;
• Your violation of these API Terms;
• Your violation of applicable laws;
• Your infringement of third-party rights.

15. Governing Law

These API Terms shall be governed by and interpreted under the laws of the State of Arizona, United States, without regard to conflict of law principles.

Any dispute arising from these API Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Phoenix, Arizona.

16. Changes to These Terms

Babasms reserves the right to update these API Terms at any time.

Updated versions will become effective upon publication on Babasms.com.

Continued use of the APIs constitutes acceptance of the revised terms.
